CPC Fully Supports Home Care Workers' Call to End 24-Hour Shifts and Make Two 12-Hour Split Shifts Universal
New York, NY – The Chinese-American Planning Council (CPC) and our subsidiary, CPC Home Attendant Program (CPCHAP), have long histories as proud union agencies. Similar to our daycare workers with DC37 and school-age directors with CSA, we respect our home care workers’ continued election of 1199SEIU as their advocate and representative. In December 2023, CPCHAP entered into a new agreement with 1199SEIU, which was ratified by our home care workers. Under this agreement, CPCHAP is paying our home care workers $19.15 per hour, which is more than the State’s hourly wage for home care workers. We also acknowledge 1199SEIU’s grievance process to address any worker concerns, including the arbitrator’s decision in February 2022 to establish a Special Wage Fund of nearly $40 million from all 42 union agencies including CPCHAP to resolve wage and hour claims, which we accept and which courts have upheld. CPCHAP is committed to doing right by our workers, as evident that we have spent nearly $6 million on overtime, bonuses, and reimbursement for travel and PPE in the past year.
We are in full support of home care workers in their call to end 24-hour shifts and to make two 12-hour split shifts universal. Unfortunately, 24-hour shifts are mandated by State law and determined by insurance companies. Under NYS Department of Health regulations, for 24-hour cases, CPCHAP gets reimbursed for 13 hours and has to find ways to fill the gap in funding the 11 hours of any interruption. For two 12-hour split shifts, CPCHAP is reimbursed for the entire 24 hours and has two workers providing care to clients. If CPCHAP could split 24-hour cases on our own, why wouldn't we? It would be better for the organization, workers, and clients. There are over 11,000 24-hour cases throughout New York State, and CPCHAP has only 39 24-hour cases and 38 12-hour split shift cases out of our total caseload of nearly 2,500. Like all home care agencies, CPCHAP does not have the power to split 24-hour shifts on our own and has therefore been advocating for State reform for years. CPCHAP remains fully committed to complying with all New York State Medicaid rules and requirements, as well as Department of Labor regulations, labor laws, court decisions, and union agreements, including how 24-hour cases are handled and how interruptions are compensated. We are doing all we can to do right by home care workers, serve patients, and reform the Medicaid system.
